Claims Trading & Distressed Investment Advice

Golub Law, PLLC attorneys frequently represent clients, including hedge funds and other "event driven" investors, investment banks and other broker/dealers, in claims trading transactions, including the purchase and sale of secured, general unsecured, derivative, reclamation, administrative and priority claims in Chapter 11 and Chapter 7 bankruptcy proceedings and international insolvency proceedings. In addition to the negotiation and documentation of the requisite assignment and transfer documentation in such transactions, the firm also performs extensive legal due diligence with respect to the nature and allowance of specific claims, and further advises clients as to the potential treatment of such claims under the facts and circumstances of a particular bankruptcy proceeding. We litigate the allowance of claims in bankruptcy court, when necessary. In the course of representing our clients in the active and increasingly international secondary market for distressed claims, we provide focused legal advice on the analysis of such claims, the regulatory implications of specific purchase and sale transactions, and the implementation of effective strategies to influence or control subsequent restructurings, reorganizations, bankruptcies and related litigation.
